Terms of Service

These Terms of Service ("Terms") are an agreement between you and Smalltown Boy AI ("we", "us"), the operator of smalltownboyai.net (the "Service"). By creating an account, buying credits or generating a video, you accept these Terms, our Acceptable Use Policy, our Privacy Policy and our Cookie Policy.

1. What the Service does

The Service uses third-party artificial intelligence models to turn two photos you upload into a short vertical video in the style of the Smalltown Boy dance trend. Outputs are generated automatically, can be imperfect, and may vary between attempts with the same photos.

2. Who can use it

You must be at least 18 years old, or the age of majority where you live, to create an account and buy credits. You must give accurate account information and keep your login secure. You are responsible for everything done through your account.

3. AI-generated content rules (AIGC)

This section sets out what you may and may not create. The full rules, with examples, are in the Acceptable Use Policy, which is part of these Terms.

3.1 Content standards

You may only upload photos of yourself, of people who have given you their consent to appear in a generated video, or of your own animals. If a person in a photo is under 18, you must have the consent of their parent or legal guardian. Every photo and every generated video must be lawful and suitable for a general audience.

3.2 Prohibited categories

You must not use the Service to upload, generate or share:

Sexual or NSFW content: nudity, sexual acts, sexually suggestive or explicit material.
Violence or gore: realistic violence, injury, blood, gore, or content that promotes violence, self-harm or terrorism.
Hate speech: content that attacks or demeans people based on a protected characteristic, hate symbols, or harassment of a specific person.
Child-unsafe content: any child sexual abuse material (CSAM) or any sexualised, exploitative or endangering depiction of a minor, real or synthetic.
Deepfakes and impersonation: videos of people who did not consent, or videos that impersonate a real person to deceive, defame, defraud or mislead.
Copyright and trademark infringement: photos you have no right to use, or content that infringes someone else's copyright, trademark or other rights.

3.3 Enforcement

If we find or are told about content that breaks section 3.2, we may remove it, warn you, restrict generation, or suspend or close your account, depending on how serious it is. Child-safety violations lead to immediate, permanent closure and a report to the National Center for Missing & Exploited Children (NCMEC) and law enforcement. Credits spent on violating content are not refunded. You can appeal a decision within 14 days through the contact page.

3.4 Reporting

Anyone can report content made with the Service through the report form or by emailing support@smalltownboyai.net. We acknowledge reports within 48 hours and handle reports involving minors first.

3.5 Moderation

Uploads and outputs pass through automated safety filters run by our AI providers, which refuse sexual, violent, sensitive or infringing material. The video storyboard is fixed and users cannot enter free-text prompts. Our team reviews reported and flagged content. Automated filters can miss things, so you remain responsible for what you upload and share.

4. Your photos and your videos

You keep any rights you have in the photos you upload. You give us a limited licence to store, process and send them to our AI providers only to generate your video and run the Service. We do not use your photos to train AI models.

Subject to these Terms and the rights of others, you may use the videos you generate for personal and social media purposes. Because outputs are made by AI, we cannot promise that a video is unique or free of third-party rights.

Generated videos are AI-made. Do not present them as real footage in a way that could mislead people.

5. Music

Each video includes the audio of the dance trend it recreates. That music belongs to its rights holders. Smalltown Boy AI is an independent fan tool and is not affiliated with or endorsed by the song's performers, writers or labels. Social platforms may apply their own music rules to your posts, such as muting audio or limiting reach.

6. Credits, payments and refunds

Videos are paid for with credits. Each video uses the number of credits shown next to the Generate button. Payments are processed by our payment partner, which acts as the merchant of record; their terms also apply at checkout.

One-time packs add credits that do not expire.
Subscriptions renew automatically every month or year until cancelled. Each month, including each month of a yearly plan, your plan's credits are added to your balance; unused subscription credits expire at the end of that month. You can cancel any time from Billing, effective at the end of the current period.
Failed videos return their credits to your balance automatically.
Refunds. Each render has a real cost, so payments are not refundable once credits from them have been used. Unused purchases can be refunded within 14 days of payment on request. When a payment is refunded, the unused credits it added are removed.

Credits have no cash value and cannot be transferred or resold. Prices may change; changes never affect credits you already hold.

7. Availability and changes

We work to keep the Service running but do not guarantee it will always be available, error-free or able to produce a particular result. We may change, pause or discontinue features. If we discontinue the Service, we will refund unused paid credits on request.

8. Ending your account

You can delete your account at any time from Settings. This deletes your photos and videos. We may suspend or close accounts that break these Terms or the Acceptable Use Policy.

9. Disclaimers and liability

The Service is provided "as is". To the extent the law allows, we disclaim implied warranties, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect or consequential losses. Nothing in these Terms limits liability that cannot be limited by law.
